GENERAL TERMS AND CONDITIONS OF SALE

Definitions
Residence, Establishment, PETRIPINI: These terms refer to the PETRIPINI Residence, sometimes also called the “Hameau de PETRIPINI,” in these General Terms and Conditions of Sale.
Client: Any natural or legal person making a reservation with PETRIPINI.
Accommodation: Refers to any house, villa, or suite available for booking through the Residence.
Stay: The period during which the Client occupies the reserved Accommodation.
Force Majeure: Unpredictable and unavoidable events that prevent the fulfillment of contractual obligations.
House Rules: Set of rules and standards Clients must follow during their Stay at the Residence.
No-show: Situation where the Client does not check in at the Residence on the scheduled start date of their Stay without prior cancellation.
ARTICLE 1: APPLICATION OF GENERAL TERMS AND CONDITIONS OF SALE
The following conditions apply to any booking of a house, villa, or suite (referred to as Accommodation) at the “Hameau de PETRIPINI” made directly via the website www.petripini.com and its booking engine petripini.amenitiz.io (Amenitiz) or by phone, email, or post.
Amenitiz is the official booking engine of the Residence.
Any reservation implies full acceptance of these General Terms and Conditions of Sale by the Client.
For reservations made through an online platform (e.g., Booking), the Terms and Conditions of the respective merchant website apply.
Booking and Amenitiz are the only booking engines managed by PETRIPINI.
Accommodations are available from 5:00 PM and must be vacated by 10:00 AM (late check-out may incur additional fees).
ARTICLE 2: GENERAL PROVISIONS
These general terms and conditions apply as soon as the services are made available by the PETRIPINI Residence on its website.
PETRIPINI may modify or supplement these terms and conditions at any time on its website. Once updated online, the modifications will apply automatically.
The general terms and conditions displayed on the reservation date remain applicable to that reservation.
ARTICLE 3: RESERVATION
Unless booking by phone, the Client independently selects the services offered by the Residence and must ensure their request matches their needs (dates, number of guests, etc.).
The booking is made per house/apartment, i.e., per Accommodation. By booking on our website, https://www.petripini.com, the Client accepts these General Terms and Conditions of Sale. The Client agrees to provide accurate and complete information (personal details, desired Stay dates, number of occupants, etc.).
A reservation is guaranteed by a 30% deposit of the total Stay amount and purchased services, payable via bank transfer or credit card.
For bank transfer payments, the reservation is confirmed upon receipt of the corresponding deposit within seven days of the reservation request; otherwise, the booking is canceled.
For credit card payments, unless a promotional Rate with specific conditions applies, the remaining balance will be automatically charged two weeks before arrival.
ARTICLE 4: CANCELLATION, MODIFICATION, AND INTERRUPTION OF STAY
All resulting fees will be due.
Any reservation by the Client confirmed via email by the booking services of the Hameau de PETRIPINI constitutes the opening and processing of the Client’s file. Any cancellation must be confirmed in writing or by email.
The cancellation terms for the standard website Rate are as follows:
• For cancellations up to 1 month before the arrival date: 5% of the deposit will be retained.
• For cancellations up to 15 days before the arrival date: only the 30% deposit will be retained.
• For cancellations within 15 days before the arrival date: 100% of the total amount will be charged.
For promotional Stays, the balance is due at the time of booking, and the amount is non-refundable and non-changeable for any reason. If the Stay is interrupted for any reason beyond the control of the Hameau de PETRIPINI, the Client will not be entitled to any refund. To cover such eventualities, we recommend subscribing to insurance.
In case of early departure, the full amount of the initial Stay will be charged as compensation without exception.
For any modifications concerning the number of guests or Stay dates, please contact the establishment directly (via email at contact@petripini.com or by phone), and efforts will be made to accommodate changes based on availability.
For non-refundable and non-changeable Rates, the reservation cannot be refunded or modified. The full amount will be charged at the time of booking.
ARTICLE 5: NO-SHOW
If the Client does not show up for their reservation, the total amount of the Stay remains due and will not be refunded, regardless of the selected Rate.
ARTICLE 6: RESERVATION MODIFICATION
For reservations with a modifiable Rate, any changes to the reservation are possible without additional fees up to 2 weeks before the Stay’s start date. The Client must pay any difference in Rate between the initial and the modified reservation, if applicable.
However, availability of Accommodations cannot be guaranteed. If a modification is not possible, the Client must either accept the initial reservation or proceed with cancellation, subject to the cancellation terms outlined in Article 4.
ARTICLE 7: RATES AND PAYMENT
Rates are displayed in euros (€), VAT included, and are subject to change without notice. The Rate includes cleaning fees, bed linens, and towels.
Payment for the Stay is made according to the terms indicated during the reservation process (such as total amount, possible service fees, and applicable cancellation policies). Cancellation and modification terms vary depending on the type of reservation and the selected Rates.
The Rates for villas and suites are displayed per Accommodation based on the period. The maximum capacity of an Accommodation must be respected; otherwise, additional fees may apply.
Although cleaning fees are included, the Residence reserves the right to charge additional fees if the Accommodation is returned in an excessively dirty or damaged condition.
The Residence reserves the right to change its Rates at any time. However, the Rates for confirmed reservations remain unchanged.
Additional services are not included in the basic Accommodation Rate but may be added by the Client during the reservation process or during the Stay. These additional services will be charged at the end of the Stay unless otherwise stated.
The tourist tax (or city tax) for the commune of Sotta will be collected at the beginning of the Stay or upon final billing. This tax is calculated per adult and per night and must be paid on-site.
Breakfast is available as an optional service offered by the establishment.
Payments by credit card through the Amenitiz booking engine are secure.
A deposit or down payment may be required at the time of booking. If no prepayment is required, a security deposit or credit card authorization will be requested upon the Client’s arrival to ensure payment for any consumed services during the Stay.
By making a reservation, the Client irrevocably accepts these General Terms and Conditions of Sale, and the reservation cannot be contested except under the terms outlined in Article 4.
ARTICLE 8: CLIENT RESPONSIBILITIES
Clients must comply with the house rules of the establishment during their Stay (e.g., no smoking, no pets, no parties, etc.).
The house rules are available at the Residence’s reception or upon request. If the house rules are not respected, the Residence reserves the right to ask the Client to leave without any compensation or refund. If the Client has unpaid charges, payment must be made before leaving the establishment.
Clients are responsible for maintaining the cleanliness and condition of the Accommodation during their Stay. Any damage caused to the property will be charged to the Client.
Clients are responsible for the security of their personal belongings. While the Residence will take reasonable measures to protect entrusted items, it accepts no liability for loss, theft, or damage not caused by the Residence’s gross negligence.
Specifically, Clients are responsible for:
• Not leaving personal belongings unattended in public areas of the establishment.
• Not giving their Accommodation key to unauthorized persons.
• Declaring valuables to the establishment and entrusting them for safekeeping if they so wish.
The Residence cannot be held liable for loss, theft, or damage resulting from the Client’s negligence or misconduct.
ARTICLE 9: RELOCATION
If the PETRIPINI Residence cannot provide the reserved Accommodation due to exceptional circumstances or force majeure, PETRIPINI reserves the right to accommodate the Client in a hotel or Residence of equivalent category offering similar services. The Client will be informed in advance, and any additional costs (e.g., room upgrade, transportation) will be the Client’s responsibility.
ARTICLE 10: ESTABLISHMENT RESPONSIBILITIES
The PETRIPINI Residence strives to display the most representative photos of the Residence on its website. However, variations may occur due to renovations, repairs, or furniture changes. These photos are not contractually binding.
PETRIPINI cannot be held responsible for reservation errors made by the Client.
The Hameau de PETRIPINI is committed to providing quality service to ensure an enjoyable Stay. However, the establishment cannot be held responsible for disturbances or incidents beyond its control.
The Residence is not liable for theft or damage to the Client’s belongings, particularly if:
• The Client failed to take reasonable security measures to protect their belongings.
• The theft or damage was caused by a force majeure event (e.g., fire, earthquake, or flood).
• The theft or damage was caused by the Client or someone accompanying them.
ARTICLE 11: CLAIMS
If you encounter any issues or have complaints during your Stay, please notify the establishment immediately to allow for appropriate action.
For concerns or questions after your Stay, contact the Residence directly for clarification.
For inquiries, feedback, or suggestions, do not hesitate to contact the establishment at contact@petripini.com.
ARTICLE 12: FORCE MAJEURE
Force majeure refers to any external event that is both unpredictable and insurmountable, preventing either the Client or the Residence from fulfilling contractual obligations. This includes cases recognized by French jurisprudence.
In such situations, both parties are exempt from liability for non-performance of their obligations. Force majeure suspends obligations for both parties, and each bears the costs arising from the situation.
ARTICLE 13: DISPUTE RESOLUTION
The contract and these general terms and conditions are governed by French law.
In case of disputes concerning these terms or the contract’s execution, the Client must first contact the Residence’s customer service.
If the dispute remains unresolved after 60 days, the Tribunal of Ajaccio will have sole jurisdiction.
If there is a conflict between the special conditions of the selected Rate and these general terms, the special conditions will prevail.
ARTICLE 14: GROUP BOOKINGS
Group bookings involving multiple Accommodations in the same reservation do not guarantee that the Accommodations will be located close to each other. It is recommended to contact the Residence for assistance in finding suitable solutions.
Group Stay bookings do not exempt Clients from respecting the Residence’s house rules, particularly regarding noise, parties, and the no-smoking policy.
ARTICLE 15: PRIVACY
The information provided by the Client on the website is used by the Residence and its partners to process bookings and respond to Client inquiries.
The Client’s payment details will be securely transmitted by the payment provider to the Residence’s booking system and bank for contract execution. The Client agrees to this data transfer for the reservation process. The payment provider guarantees confidentiality and security measures for these transfers.
The Client has the right to oppose the use of their data for promotional purposes. Under the French Data Protection Act of January 6, 1978, they also have the right to access, correct, and object to their data by contacting contact@petripini.com.
The Hameau de PETRIPINI may send emails about past or future Stays, promotional offers, or satisfaction surveys. Clients can unsubscribe using the link at the bottom of each email or contact the Residence to stop receiving emails.
